Sanctions

• Failure to submit a posting declaration

Administrative fine
Failure to submit information on the working conditions established in Article 108 (2) of the Labour Code of the Republic of Lithuania applicable to a posted employee to the State Labour Inspectorate imposes a fine on employers or other responsible persons from EUR 360 to EUR 660.
In case of repeated infringement, the fine ranges from EUR 660 to EUR 1320.

Article 101 (1) and (2) (repeated infringement) of theCode of Administrative Offences of the Republic of Lithuania.

Article 109 (1) of the Labour Code of the Republic of Lithuania.

Challenging the penalty
The fine can be challenged before the Court. A complaint can be submitted to the District Court in 20 calendar days after receiving the decision of imposing administrative fine.

• Failure to apply appropriate working conditions

Administrative fine
Non-application or incorrect application of the guarantees provided for in Section 2 of Chapter VII of Part II of the Labour Code of the Republic of Lithuania to posted workers imposes a fine on employers or other responsible persons from EUR 420 to EUR 900.
In case of repeated infringement, the fine ranges from EUR 900 to EUR 1680.
